October 2026 Newsletter

The DEA’s administrative stay on rescheduling proceedings, paired with recent equity research from Zuanic & Associates, projects that adult-use Schedule III tax relief is officially pushed out to mid-to-late 2027.
For business owners holding out for a post-rescheduling price surge, waiting on Washington creates a serious financial trade-off. Absorbing another 12 to 18 months of 280E tax drag, high-interest debt service, and ongoing market price compression erodes far more equity than any prospective future valuation bump could yield. Meanwhile, strategic consolidators (like Vireo, TerrAscend, and MariMed) are actively acquiring cash-flowing businesses and turn-key properties right now.

INDUSTRY INSIGHTS
The Site Control Crunch: License Holders Race the Clock in Delaware & Beyond
Across the country, the biggest bottleneck in commercial cannabis is no longer winning a state license, but finding a compliant building to put it in.
In Delaware, where adult-use licenses have been awarded, operators face strict statutory deadlines to open. However, licensees in New Castle County are hitting a severe real estate standstill due to strict local setbacks, municipal buffer zones, and a scarcity of industrial-zoned properties.
This site-control crisis is playing out nationwide:
- Los Angeles, CA: Unrestricted cultivation licensing opened on October 19, igniting an aggressive bidding war for heavy-power industrial facilities.
- Washington, D.C.: Regulators enacted emergency legislation allowing conditional licensees to use temporary zoning certificates instead of full Certificates of Occupancy to prevent licenses from expiring under 3-year clocks while winners search for property.
- Rhode Island: Reopened retail licensing for 24 locations, enforcing municipal site control as a non-negotiable prerequisite.
For Property Owners & Sellers: Pre-zoned commercial properties, turn-key buildouts, and locations with local municipal approval command significant market premiums. If you own compliant industrial or retail real estate, buyer demand is at an all-time high.
Ohio Shows What Happens When Hemp Leaves the Shelves
Ohio offers a clear preview of how tightening hemp regulations impact licensed cannabis markets. Ten months after Governor Mike DeWine signed Senate Bill 56 banning unregulated intoxicating hemp-derived products outside licensed dispensaries, market data reveals significant gains for licensed operators.
According to Zuanic & Associates and state revenue data, Ohio cannabis sales reached $351 million in Q3 2026 (+31% YoY). Crucially, average retail flower prices rose to $6.17 per gram in Q3 (up from $5.82 at year-end 2025) as consumer demand shifted cleanly into licensed dispensaries.
- Strong Store Economics: Ohio’s 232 dual-use dispensaries average roughly $6 million in annual revenue per store.
- Creative Site Conversions: Real estate resourcefulness is key. Certified Cultivators recently announced plans to open its sixth dispensary in a former Frisch’s Big Boy restaurant in Cherry Grove.
- Federal Benchmark: With federal Farm Bill hemp restrictions taking effect on December 11, Ohio proves that removing intoxicating hemp products creates immediate top-line tailwinds for licensed dispensaries.
New Research: Dispensaries Drive Foot Traffic to Neighboring Businesses
A new multi-university study from researchers at the City University of New York (CUNY), Northern Illinois University, and the University of Miami provides powerful data for landlords and operators facing local municipal pushback.
Examining credit and debit card transactions in Illinois from 2021 to 2024, researchers found that after a retail dispensary opened:
- Nearby business customer visits rose by 6.82%
- Total transaction volume grew by 8.01%
- Neighboring merchant revenue increased by 7.47%
Revenue per customer barely moved, so the gains came from more people showing up rather than existing shoppers spending more. Food & beverage establishments and essential retailers experienced the highest spillover gains. Combined with CDC youth usage data showing drops in teen use after legalization, operators now have strong empirical proof to defeat objections at municipal zoning hearings.
